Booking Terms & Conditions

1. Introduction, About Us and These Terms


These Booking Terms & Conditions (“Booking Terms”) apply to accommodation bookings made with Loughview at Redcastle.

Loughview at Redcastle is a trading name used by Steve Coyle, a sole trader, established in Northern Ireland (“we”, “us” or “our”).

Our holiday accommodation (“the Property”) is situated at Apartment 7, Redcastle Hotel, Redcastle, County Donegal, Republic of Ireland, F93 D702.

The Property is privately owned and operated independently of Redcastle Hotel. Your accommodation booking is with us and not with the hotel. Unless we expressly state otherwise as part of your booking, hotel facilities and services are independently operated and do not form part of the accommodation booking.

These Booking Terms explain the basis upon which we accept and provide accommodation bookings, including matters relating to:

  • making and confirming a booking;
  • prices and payments;
  • cancellations and changes;
  • arrival and departure;
  • use of the Property;
  • guest responsibilities;
  • damage and additional costs;
  • safety and emergencies;
  • complaints; and
  • our respective rights and responsibilities.

By making a booking, the Lead Guest agrees to these Booking Terms and to any booking-specific terms or supporting contractual policies that were clearly disclosed and applicable to the booking.

The Lead Guest is responsible for ensuring that members of the booking party and permitted visitors are made aware of the rules and requirements that apply to their use of the Property.

Nothing in these Booking Terms excludes, restricts or replaces any mandatory consumer right or legal protection that cannot lawfully be excluded or restricted.

2. The Property and Relationship with Redcastle Oceanfront Golf & Spa Hotel


The Property is Apartment 7, Redcastle Hotel, Redcastle, County Donegal, Republic of Ireland, F93 D702.

Although the Property is situated within the Redcastle Hotel environment, it is privately owned and operated independently of Redcastle Hotel.

Your accommodation booking is made with Loughview at Redcastle and not with Redcastle Oceanfront Golf & Spa Hotel, its agents or representatives. Redcastle Hotel and its agents or representatives do not manage your accommodation booking, payments, cancellations, refunds, security deposit, access arrangements or complaints relating to the Property.

Facilities and services operated by Redcastle Hotel, its agents or representatives, or another third party — including, where available, restaurants, bars, leisure facilities, swimming pools, spa facilities and other hotel services — are separate from your accommodation booking unless we expressly state in writing that a particular facility or service is included.

The availability, opening hours, prices, booking requirements, age restrictions, rules and conditions of any hotel or third-party facility are determined by the relevant operator and may change independently of us.

Guests wishing to use those facilities may be required to book or pay the relevant operator directly and must comply with any terms, rules or restrictions imposed by that operator.

References to Redcastle Hotel, its location or nearby facilities on our Website, in photographs, descriptions or other booking information are provided to describe the location and surroundings of the Property and must not be understood as representing that the Property is owned, managed, endorsed or operated by Redcastle Hotel.

If you experience a problem with the Property or your accommodation booking, you should contact Loughview at Redcastle using the contact details provided with your booking rather than asking hotel staff to resolve the matter.

5. Pending Bookings and First-Come-First-Paid


An unpaid or pending booking does not necessarily reserve the Property indefinitely.

Where payment is required to confirm a booking, we operate on a first-come-first-paid basis.

Until the required payment has been received and the booking confirmed, the dates may remain available to other guests.

Where a payment deadline is provided, failure to make payment by that deadline may cause the pending booking to expire automatically

6. Booking Confirmation and Contract Formation


A booking becomes confirmed when the required payment has been successfully received or accepted and we issue a booking confirmation.

Please check your confirmation promptly and tell us if anything is incorrect.

The booking contract consists of:

  • your booking confirmation;
  • these Booking Terms & Conditions; and
  • any policies or House Rules expressly incorporated into the booking.

7. Prices, Currency and What Is Included


 The price payable will be shown before you complete your booking.

Our website may display prices in both GBP and EUR for convenience.

Unless expressly stated otherwise, card transactions are charged in GBP.

Your bank or card provider may apply its own currency conversion rate or charges where your account is held in another currency.

Where offered, bank-transfer payments may be accepted in GBP or EUR.

Only accommodation, facilities and services expressly stated as included in the booking form or booking confirmation are included in the booking price

8. Payments, Deposits and Balance Payments


 Depending on the booking, we may require:

  • payment in full;
  • a booking deposit followed by a balance;
  • agreed part payments; or
  • another payment arrangement confirmed by us.

The amounts and applicable payment dates will be displayed during booking or stated in your booking confirmation.

You are responsible for ensuring that payments are made by their due dates.

Failure to make a required payment may result in cancellation of the booking in accordance with our Payment Terms and Cancellation & Refund Policy.

9. Security Deposit


 A security deposit may be required.

Where applicable, its amount and payment or authorisation arrangements will be disclosed before it becomes payable.

The security deposit may be used towards reasonable amounts properly due as a result of matters including damage, missing items, lost keys, excessive cleaning or other costs caused by the booking party.

The security deposit is not a limit on the Lead Guest's responsibility. Where reasonable costs properly due exceed the security deposit, the balance may remain payable.

10. Discounts, Coupons and Promotional Offers


Discounts and promotional codes are subject to any conditions stated with the relevant offer.

Unless expressly permitted, discounts cannot be combined.

A booking receiving a discount, including a 100% accommodation discount, remains subject to these Booking Terms, House Rules and any applicable security deposit or additional charges.

11. Changes Requested by the Guest


 If you wish to change your booking, please contact us as soon as possible.

Changes are subject to availability and are not guaranteed.

Any difference in price or other applicable charge will be explained before the change is confirmed.

12. Cancellation by the Guest


If you wish to cancel, you should notify us as soon as possible.

Cancellation charges and refund entitlement are determined by the Cancellation & Refund Policy applicable to your booking.

Holiday accommodation booked for specified dates does not generally carry the standard cooling-off right that applies to many other online consumer purchases.

This does not affect any other statutory rights that apply to your booking.

We recommend that guests consider appropriate travel insurance.

13. Cancellation or Changes by Us


We may occasionally need to cancel or materially change a booking because of circumstances such as serious property damage, safety concerns, essential repairs or another event that means the accommodation cannot reasonably be provided.

We will notify you as soon as reasonably practicable.

Where we cannot provide the accommodation contracted for, any refund or other remedy will be dealt with in accordance with the circumstances and applicable consumer law.

14. Arrival, Check-In and Access


Your check-in time and access instructions will be provided before arrival.

Early check-in is not guaranteed unless specifically agreed.

Keys, access codes and other security information must be kept secure and must not be given to unauthorised persons.

Please report any significant problem with the Property promptly after arrival.

15. Departure and Check-Out


Guests must leave the Property by the stated check-out time unless a later departure has been agreed.

Before leaving, guests should:

  • remove their personal belongings;
  • dispose of rubbish as instructed;
  • leave the Property reasonably tidy;
  • return keys or access devices as instructed; and
  • report significant damage or breakages.

Normal changeover cleaning does not include excessive or specialist cleaning caused by the condition in which the Property is left.

16. Maximum Occupancy, Registered Guests and Visitors


The maximum occupancy stated for the Property must not be exceeded.

Only registered or authorised guests may stay overnight.

Visitors are permitted only where consistent with the House Rules and remain the responsibility of the Lead Guest.

The Property must not be used for unauthorised parties, events or gatherings. 

17. Use of the Property


The Property is provided for temporary holiday and short-stay accommodation.

It must not be used for illegal activity or, without our prior agreement, for commercial activity, parties, events, professional filming or another materially different purpose.

Guests must use the Property, furniture, appliances and equipment reasonably and for their intended purposes.

18. House Rules


The House Rules form part of the conditions applying to your stay.

They cover practical matters including occupancy, visitors, noise, smoking, fire safety, pets, security, parking, cleanliness and care of the Property.

The Lead Guest is responsible for ensuring that their booking party and visitors comply with them.

19. Noise, Parties and Guest Conduct


Guests must behave reasonably and show consideration towards neighbours, residents, hotel guests, staff and other users of shared areas.

Unauthorised parties and events are prohibited.

Excessive noise, threatening or abusive behaviour and serious anti-social behaviour are not permitted.

20. Smoking, Vaping, Pets and Other Restrictions


Smoking and vaping are prohibited inside the Property.

Guests must comply with the Smoking & Vaping Policy.

Pets may only be brought to the Property where permitted by the booking and must comply with the Pet & Assistance Animal Policy.

Applicable legal rights concerning assistance animals are not affected.

21. Fire Safety and Safety Equipment


Guests must comply with all fire and emergency instructions provided at the Property.

Guests must never cover, disconnect, remove, disable, damage, interfere with or tamper with any smoke alarm, heat detector, carbon-monoxide alarm, fire door, fire extinguisher, fire blanket, emergency lighting, signage or other fire or life-safety equipment.

Escape routes must be kept clear.

Any fault involving safety equipment must be reported immediately.

Deliberate or reckless interference with fire or life-safety equipment will be treated as a serious breach of these Terms.

22. Care of the Property


Guests must take reasonable care of the Property and its contents.

Damage, significant breakages, leaks or other problems should be reported promptly so that further damage can be prevented where possible.

Fair wear and tear will not be charged to guests.

23. Damage, Breakages, Missing Items and Excessive Cleaning


Where damage, loss or excessive cleaning results from the acts, omissions, negligence, misuse or breach of these Terms by the Lead Guest, booking party or permitted visitors, we may recover the reasonable costs directly resulting from the matter.

Where appropriate, we will consider:

  • repair rather than replacement;
  • the age and condition of damaged items;
  • fair wear and tear;
  • reasonable contractor or cleaning costs; and
  • available evidence.

We will not use damage charges to obtain an unreasonable improvement or betterment at the guest's expense.

24. Lead Guest Liability and Recoverable Costs


The Lead Guest may be responsible for reasonable and evidenced costs directly caused by the acts, omissions, negligence, misuse or breach of these Terms by themselves, members of their booking party or permitted visitors.

These may include reasonable costs relating to:

  • damage or missing property;
  • excessive or specialist cleaning;
  • smoke or odour remediation;
  • replacement keys or access devices;
  • locksmith attendance;
  • emergency plumbers, electricians or other contractors;
  • damage to common areas;
  • security or building-management attendance;
  • inspection, resetting, repair or replacement of fire or safety equipment; and
  • Fire Service or other emergency attendance charges actually imposed upon us where the attendance resulted directly from deliberate, reckless or negligent guest conduct.

These provisions are intended to recover reasonable losses and costs actually incurred and are not intended to impose arbitrary penalties.

25. Security Deposit Is Not a Limit on Liability


A security deposit provides security against amounts properly due under the booking contract.

It does not create a maximum liability.

For example, if reasonable and evidenced costs properly recoverable under these Terms exceed the amount of the security deposit, the Lead Guest may remain responsible for the difference.

Equally, we will not retain any part of a security deposit unless there is a reasonable basis for doing so.

26. Access to the Property During the Stay


We respect guests' privacy.

We or an authorised representative may nevertheless require access where reasonably necessary because of an emergency, urgent maintenance, safety or security concern, significant reported damage or another legitimate property-management requirement.

Where circumstances permit, reasonable notice will be given.

27. Hotel, Common Areas and Third-Party Facilities


Redcastle Hotel and facilities such as its leisure centre, swimming pool, spa, restaurant and bar are independently operated unless expressly stated otherwise.

Their availability, prices and rules are controlled by the relevant operator.

Hotel staff do not manage your holiday-let booking unless expressly stated.

Guests must respect applicable rules when using shared or common areas.

28. Parking and Vehicles


Guests must park only where permitted and must not obstruct entrances, exits, emergency routes or other vehicles.

Guests are responsible for damage caused by their vehicles or their visitors' vehicles.

Electric vehicles, e-bikes and similar equipment must only be charged using authorised facilities and in accordance with the Parking & Vehicle Policy.

29. Wi-Fi, Utilities and Other Services


Where Wi-Fi is provided, it is supplied for reasonable guest use.

Internet speed and availability may vary.

Guests must not use the connection for unlawful purposes or interfere with network equipment.

Unexpected utility or telecommunications interruptions should be reported promptly so that we can take reasonable steps to investigate them.

30. Health, Safety and Emergencies


Guests must take reasonable care for their own safety and that of others.

In an immediate emergency requiring Gardaí, Fire Service or ambulance assistance, call 112 or 999.

Guests should familiarise themselves with the Property's fire and emergency information after arrival.

Children and other persons requiring supervision must be appropriately supervised.

Serious hazards, leaks, electrical concerns or defective safety equipment must be reported promptly.

31. Personal Belongings and Lost Property


Guests should check carefully for personal belongings before departure.

Items found after departure will be dealt with under our Lost Property Policy.

Where you ask us to return an item, reasonable postage, packaging or courier costs may be payable before dispatch.

32. Problems During the Stay and Guest Duty to Report


Please tell us promptly if something is materially wrong with the accommodation.

This allows us to investigate and, where appropriate, take reasonable steps to resolve the problem during your stay.

Reporting arrangements do not remove or restrict any statutory consumer rights.

33. Serious Breaches and Termination of Stay


Serious or persistent breaches of these Terms or the House Rules may result in the booking being terminated and guests being required to leave.

Examples include:

  • violence or credible threats;
  • serious anti-social behaviour;
  • deliberate significant damage;
  • illegal activity;
  • serious unauthorised parties;
  • deliberate interference with fire or safety equipment; or
  • conduct creating a serious and immediate risk to people or property.

Any action taken will depend on the circumstances and seriousness of the breach.

Any amounts retained or subsequently claimed following termination must have a proper contractual and legal basis and will not constitute an arbitrary penalty.

34. Our Responsibility and Matters Outside Our Control


We are responsible for providing the accommodation service in accordance with the booking contract and applicable law.

Nothing in these Terms excludes or restricts liability or consumer rights where doing so would be unlawful.

We are not responsible for independently operated services merely because they are located at or near Redcastle Hotel or are mentioned on our website.

Where circumstances outside our reasonable control affect your stay, we will deal with the situation reasonably and in accordance with applicable legal obligations.

35. Privacy and Personal Information


We process personal information for purposes including administering bookings, processing payments, communicating with guests, managing the Property, preventing fraud and dealing with complaints, incidents or damage.

36. Complaints


If you experience a problem, please contact us as soon as reasonably possible.

This gives us an opportunity to investigate and, where appropriate, resolve the matter.

Complaints concerning independently operated hotel or third-party services may need to be made directly to the relevant operator.

37. Consumer Rights


Nothing in these Booking Terms excludes, limits or replaces any mandatory consumer rights or remedies applicable to your booking.

The Property is situated in the Republic of Ireland and applicable Irish consumer and regulatory requirements relating to the provision of the accommodation will be observed where they apply.

Because the accommodation provider is established in Northern Ireland and guests may reside in different jurisdictions, other mandatory consumer protections may also apply depending on the circumstances.

38. Governing Law and Jurisdiction


The Property is situated in the Republic of Ireland and its operation is subject to applicable Irish laws and regulatory requirements where those laws apply to the Property or accommodation service.

The accommodation provider is a sole trader established in Northern Ireland.

Where the parties are legally permitted to choose the applicable law, these Booking Terms and the booking contract are governed by the laws of Northern Ireland.

However, nothing in this provision is intended to:

  • deprive a consumer of mandatory consumer protections that apply to them;
  • exclude mandatory laws applying to the Property or accommodation service in the Republic of Ireland; or
  • require a consumer to bring proceedings exclusively in a particular jurisdiction where applicable law gives that consumer the right to bring proceedings elsewhere.

The courts having jurisdiction over any dispute will therefore be determined in accordance with the applicable rules governing jurisdiction and consumer contracts.

39. Relationship with Other Policies


These Booking Terms form the principal terms governing your accommodation booking.

Your booking may also be subject to booking-specific information and the following supporting terms and policies, where applicable:

These documents provide additional terms and practical requirements relevant to particular aspects of your booking and stay.

We also publish information, statements and notices concerning the Property and our services, including:

  • Fire & Emergency Information;
  • Health, Safety & Guest Safety Policy;
  • Lost Property Policy;
  • Hotel & Third-Party Facilities Disclaimer;
  • Privacy Notice;
  • Cookie Policy;
  • Website Terms of Use;
  • Accessibility Statement;
  • Photography, CCTV & Security Notice; and
  • Complaints Policy.

These documents provide important information about matters such as safety, privacy, accessibility, website use, third-party facilities and the handling of complaints. They do not automatically form contractual terms merely because they are published or referred to alongside these Booking Terms.

Order of Precedence

If there is an apparent conflict between documents governing an accommodation booking, they should be interpreted, so far as reasonably possible, consistently with one another.

Where a conflict cannot reasonably be reconciled, the following order will generally apply:

  1. any specific terms or conditions expressly agreed for the particular booking;
  2. these Booking Terms & Conditions; and
  3. the applicable supporting contractual policy dealing specifically with the matter concerned.

A booking-specific term will only take precedence where it was clearly disclosed and agreed as part of that booking.

Nothing in this section permits a booking-specific term, these Booking Terms or another policy to exclude, restrict or override a mandatory consumer right or other legal requirement that cannot lawfully be excluded or restricted.

Information notices and statements, including our Privacy Notice and Cookie Policy, continue to apply according to their own purpose and applicable law.
